Mrs. Nutan Sahay, AC to AAG-12 ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJIV ROY ORAL ORDER 18-08-2025 Heard Mr. Arun Kumar No.1, learned counsel for the petitioner and Mrs. Nutan Sahay, learned AC to AAG-12.
2. The present petition has been preferred for the grant of following relief(s):
"for issuance of writ in the nature of mandamus directing the respondents no.4, (Circle Officer, Cheria Bariarpur) to comply the order dated 08.08.2012 passed by the court of learned DCLR, Manjhaul in Bihar Land Dispute redressal case no. 36/2012 within a short fixed period whereby and where under the learned DCLR court has strictly directed the respondent
Patna High Court CWJC No.17227 of 2016(2) dt.18-08-2025 2/3 no.4 (Circle Officer, Cheria Bariarpur) to issue rent receipt to the 13 dhur lands of the petitioner bearing plot no.3219, 3238 & to get this land demarcated after measurement of the same. But despite of submission of the said order dated 08.08.2012 to the Circle Officer, the said order has not been complied with by the Circle Officer, Cheria Bariarpur as yet for the reason best known to him as such petitioner has now no option but to move before this Hon'ble Court for securing the ends of justice and further for issuance of any other writ or writs, direction or directions as it may be deemed fit and proper to the facts and circumstances of this case."
3. The State counsel has preliminary objection that the individual against whom the petitioner wants demarcation of land has not even been made party respondent in this case. She has further taken this Court to the paragraph no.7 of the counter affidavit to show that the petitioner was not found in possession of the land.
4. The copy of the counter affidavit was served upon the learned counsel for the petitioner in the year 2019 without
Patna High Court CWJC No.17227 of 2016(2) dt.18-08-2025 3/3 any rebuttal, clearly he has accepted the averments made in the said reply.
5. In the said scenario, learned counsel for the petitioner submits that he shall be approaching the appropriate Revenue Officer for the redressal of the grievance.
6. Said liberty is always there, the writ petition stands disposed of.
