JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-09-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier, the prayer for bail of the petitioner was rejected by this Court at initial stage but now petitioner has already spent near about nine months in custody. Petitioner does not have any criminal antecedent which is evident from perusal of Para-3 of the petition.

No doubt, in huge quantity of spirit is said to have been recovered from a vehicle which was being driven by the petitioner but it is informed on behalf of the petitioner that the trial of the petitioner has not been commenced as yet. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above
