2. The petitioner seeks bail in connection with Shikarpur P.S. Case No. 275 of 2025 registered for the offence punishable under Sections 103, 3(5) and 238 of the Bharatiya Nyaya Sanhita.

3. The petitioner is the husband of the deceased. He is said to have killed the deceased.

4. The petitioner is in custody since 04.09.2025 having no criminal antecedent.

5. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.31508 of 2026(2) dt.14-05-2026 2/3 marriage was about 9 years old and the deceased and the petitioner are having three children. He further submits that the children are staying with the parents of the petitioner. He further submits that there is no progress in the trial even though the petitioner is in custody.

6. Considering the aforesaid, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned District & Additional Sessions Judge 1st cum-Spl. Judge, SC/ST, West Champaran at Bettiah/ concerned Court in connection with Shikarpur P.S. Case No. 275 of 2025.

8. At the time of accepting the bail bonds of the petitioner, the Court below will verify the fact as to whether the three children are staying with the parents of the petitioner or not. If it is found that the children are staying with the parents of the petitioner, the bail bonds shall be accepted and if not the bail bonds of the petitioner shall not be accepted by the Court below.

9. It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at
