JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 12-12-2017 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Bidupur P.S. Case No.290 of 2017 registered under Sections 147, 148, 149, 447, 341, 323, 307, 379, 354, 504 and 506 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioners that the allegation against the petitioners is only for causing damage to the wall of the informant and the said offence is bailable in nature. She submitted that petitioners no.2 and 3 are students studying in Patna and petitioner no.1 is seventy three

Patna High Court Cr.Misc. No.58439 of 2017 (2) dt.12-12-2017 2/2 years old man, a retired Army officer. They have got roots in the society.

Learned counsel for the State has opposed the prayer for grant of anticipatory bail to the petitioners. Considering the submissions made above and also the nature of allegation made in the FIR, in the event of arrest or surrender before the court below within six weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- XIV, Vaishali at Hajipur in connection with Bidupur P.S. Case No.290 of 2017, subject to the conditions as laid down 438(2) of the Code of Criminal Procedure.
