2. Petitioner seeks regular bail in a case registered for the offence punishable under Sections 30(a), 41(1) of the Bihar Prohibition and Excise Amendment Act.

3. As per the prosecution case, 110 liters of illicit liquor was recovered from spot.

4. Learned counsel for the petitioner submits that he is innocent and has committed no offence. No incriminating material has been recovered from conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner is in custody since 29.01.2026 . Chargesheet has already been submitted.

5. Learned A.P.P. for the State vehemently opposes the

Patna High Court CR. MISC. No.32071 of 2026(2) dt.15-05-2026 2/2 bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 1, East Champaran at Motihari in connection with Turkauliya PS Case No. 71 of 2025 .
