The petitioner seeks regular bail in connection with Jalalgarh P.S. Case No. 214 of 2022, registered for the offence punishable under Sections 147, 149, 341, 323, 379, 354, 324, 504, 506, 307 of the Indian Penal Code.

As per the prosecution case, the allegation against the petitioner is that he has given farsa blow on the head of the son of the informant.

Learned counsel for the petitioner submits that the petitioner and informant are co-villager and due to money dispute some scuffle took place between the parties causing simple injury to the son of the informant and the informant has falsely implicated the petitioner in this case. As per the injury

Patna High Court CR. MISC. No.30848 of 2023(2) dt.15-06-2023 2/2 report the injury on injured found simple in nature and not support the prosecution case. There is no repetitive blow and no offence is made out under Section 307 of the I.P.C. The petitioner is in judicial custody since 24.01.2023 and he has no criminal antecedent.

Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Jalalgarh P.S. case no.- 214 of 2022.
