JUSTICE ALOK KUMAR PANDEY ORAL ORDER (Per: HONOURABLE MR. JUSTICE P. B. BAJANTHRI) 17-02-2024 For non-compliance of orders of this Court, petitioner has presented the present M.J.C. No. 952 of 2022. On 09.01.2024, the following order was passed :- "Due to lack of communication of Notice to the petitioners, the District Magistrate proceeded to pass order without hearing the petitioners.
Therefore, petitioners are hereby directed to appear before the District Magistrate, Saharsa on 30th January, 2024 at 3:00 P.M.
2. District Magistrate, Saharsa is hereby directed to hear the petitioners in the event of production of any document on behalf of the petitioners, the same shall be entertained and
Patna High Court MJC No.952 of 2022(5) dt.17-02-2024 2/2 thereafter proceed to pass order afresh after taking note of each of the contention and documents to be made available by the petitioners. In the event of private parties, whose rights are likely to be affected in the event of granting any relief to the petitioners, in that event, District Magistrate, Saharsa is hereby directed to secure the presence of such of those private respondents, whose rights are likely to be affected and they may also be heard on 30th January, 2024."
2. Today, learned counsel for the State/Respondents filed show cause on behalf of opposite party nos. 2 to 5 along with Annexure- A and B. Taking note of Annexure-B dated 31.01.2024, we are satisfied with the compliance.
3. Accordingly, the present M.J.C. No. 952 of 2022 stands dropped reserving liberty to the petitioner to assail the order dated 31.01.2024 (Annexure-B) to the show cause). (P. B. Bajanthri, J) ( Alok Kumar Pandey, J) alok/- U
