2. This is the second attempt of the petitioner for grant of regular bail as earlier the bail application of the petitioner was rejected vide order dated 19.10.2023 passed in Cr. Misc. No. 68569 of 2023.

3. The petitioner seeks bail in connection with Jadiya P.S. Case No. 77 of 2022 registered for the offence punishable under Sections 406, 420, 413, 379 and 120B/34 of the Indian Penal Code.

4. As per the prosecution case, the informant gave Rs. 2,10,000/- to the petitioner to purchase gold biscuit. Thereafter, the accused persons took out Rs. 3,000/- from the pocket of the informant and the accused persons including the petitioner looted three mobiles from the informant.

5. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.34785 of 2024(2) dt.12-07-2024 2/2 petitioner is innocent and has been falsely implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is in jail since 14.09.2023.

6. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

7. The petitioner is accused in serious cases of loot, cheating and NDPS Act.

8. Considering the criminal antecedent of the petitioner, I am not inclined to grant bail to the petitioner though co-accused Shyamsunder Kumar @ Shyamsunder Yadav @ Shyam has been granted bail by this Court.

9. Accordingly, this application is dismissed.

10. The District Judge, Supaul is directed to expedite the trial of all the cases registered against the petitioner.
