JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-07-2017 Heard the parties. The petitioners seek anticipatory bail in connection with Parwalpur P.S.Case No. 68 of 2018, registered for offences punishable under Sections 341, 323, 307, 379, 504 of the Indian Penal Code and Section 27 of Arms Act.
As per F.I.R., allegations against the petitioner No. 1 is of snatching the gold ear ring of the wife of the informant and petitioner No. 2 is of abusing the wife of the informant and father of the petitioners namely, Akhilesh Jamadar also fired from his country made pistol upon the informant, causing injury. Submission of the learned counsel for the petitioners is that there is a case and counter case between the parties and
Patna High Court Cr.Misc. No.44626 of 2018 (2) dt.31-07-2017 2/2 injuries are simple in nature.
Learned A.P.P. opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioners, above named, surrender be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st , Nalanda at Biharsharif in connection with Parwalpur P.S.Case No. 68 of 2018, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
