2. The petitioner seeks bail, who is in custody since 03.02.2026 in connection with Sasaram (Muffasil) P.S. Case No. 287 of 2025, FIR dated 31.08.2025 registered for the offence under Section 25(1-B)a, 26, 3(5) of the Bharatiya Nyay Sanhita, 2023.

3. According to the prosecution case, police recovered three pistol and three live cartridges from the house of the petitioner.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case. Although recovery has been made from

Patna High Court CR. MISC. No.29473 of 2026(2) dt.04-05-2026 2/2 the house of the petitioner but petitioner is not the absolute owner of the house in question and the petitioner is rotting in judicial custody since 03.02.2026.

5. Learned A.P.P. for the State on the basis of material available on record has vehemently opposed the prayer for bail of the petitioner and submits that three pistol and three live cartridges were recovered from the house of the petitioner and there is compliance of mandatory provisions of Section 103 of BNSS.

6. Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail in connection with Sasaram (Muffasil) P.S. Case No. 287 of 2025 pending in the Court of Chief Judicial Magistrate, Rohtas, Sasaram.

7. Prayer is refused.
