2. The petitioner seeks bail in connection with Sessions Trial No. 18 of 2024 arising out of Bhabhua P.S. Case No. 719 of 2023 registered for the offence under Sections 341, 323, 324, 307, 34 of the Indian Penal Code and later on Section 302 of the Indian Penal Code was also added.

3. As per the prosecution case, the petitioner and others are said to have assaulted the victim. The petitioner is said to have given Farsa blow due to which the victim has sustained injuries and during the course of treatment, the victim died.

4. The petitioner is in jail since 18.9.2023.

5. Considering the serious allegations levelled against the petitioner, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this application is dismissed.

7. The Superintendent of Police, Kaimur at Bhabhua is directed to see to it that the witnesses are examined on the dates fixed in the trial and if the trial is delayed due to the fault of the prosecution side then the petitioner may renew his prayer for bail.

8. Let a copy of this order be communicated to the Superintendent of Police, Kaimur at Bhabhua through FAX for its compliance.
