2. The petitioner is in judicial custody in connection with Suryapura P.S. Case No. 163 of 2024 for the offence punishable under Sections 341, 323, 324, 325, 307, 504, 506/34 of the Indian Penal Code lodged on 10.06.2024 by the informant, Rohit Kumar.

3. As per the prosecution story, the informant alleged that while he was returning home, the accused persons assembled and this petitioner gave blow on his head causing injury. When the family members came to rescue, beside this petitioner, Yogendra Ram, Hridyanand Ram and Satyendra Ram also assaulted Chunmun Ram and Mohan Ram. Later, Chunmun Ram succumbed to the injuries. This led to the FIR.

4. Learned counsel for the petitioner submits that two

No.30144 of 2025(6) dt.12-12-2025 2/2 allegations are there against him, firstly assaulting on the head of the informant, Rohit Kumar and then only omnibus allegation of assaulting Chunmun Ram and Mohan Ram. Those who assaulted Chunmun Ram and Mohan Ram namely Hridyanand Ram and Satyendra Ram have been extended relief.

5. Learned APP, Mr. Jitendra Kumar Singh on the other hand has submitted that the two accused have been granted bail in Cr. Misc. No. 80976 of 2024 (Hridyanand Ram vs. The State of Bihar) and Cr. Misc. No. 75914 of 2024 (Satyendra Ram vs. the State of Bihar), in that orders, the coordinate bench has recorded that this petitioner is the assailant.

6. This Court has also taken note of the fact that twice this petitioner gave blows, firstly to the informant on his head and thereafter to Chunmun Ram and Mohan Ram. Chunmun Ram is no more.

7. In that background, for the present, this Court is not inclined to extend him the privilege of bail which is accordingly rejected.
