This application for anticipatory bail arises out of Danapur P.S. Case No. 229 of 2016 for the offence punishable under Sections 406 and 420 of the Indian Penal Code and Section 138 of the N.I. Act.

It is not in dispute that the cheque, which stood dishonoured, was issued by co-accused Ajay Kumar and not by this petitioner. Said Ajay Kumar has been allowed regular bail by this Court by order dated 21.01.2019 passed in Cr. Misc. No. 78940 of 2018.

Learned counsel appearing on behalf of the complainant has opposed the prayer for bail.

However, in the facts and circumstances of the case, I find that a case for grant of anticipatory bail is made out. This application is accordingly allowed.

No.32193 of 2019(3) dt.16-05-2019 2/2 Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1, Danapur, Patna, in Danapur P.S. Case No. 229 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
