The petitioner is apprehending her arrest in a case registered under Section 306 of the Indian Penal Code. Allegation is that on 13.11.2019 at about 9 a.m. the informant received telephonic information that his son had committed suicide by hanging at his rented house at Nokha and thereafter he along with his family members reached there and saw that the dead body of his son Ranjeet Kumar was hanging from ceiling of roof.
Patna High Court CR. MISC. No.30986 of 2020(2) dt.22-01-2021 2/2 It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner is a lady, against whom it is alleged that because of her, the husband has committed suicide, but there is no evidence of abetment on the part of the petitioner. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Nokha P.S. case No.226 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
