JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-09-2019 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Shahpur Patori P.S. Case No. 413 of 2018, registered for the offences punishable under Sections 302, 120B and 34 of the Indian Penal Code. Prosecution case is that on 07.12.2018 at about 9.00 p.m. petitioner and co-accused Arun Mahto left the father of informant at house and after sometime, the condition of his father started deteriorating. It is suspected that this petitioner and co-accused gave some poisonous substance, as a result of which he died in the hospital.

It is submitted on behalf of the petitioner that save and except suspicion there is no material against this petitioner. Coaccused Arun Mahto has been granted bail by a Coordinate Bench of this court vide order dated 08.08.2019 passed in Cr.

Patna High Court CR. MISC. No.30396 of 2019(4) dt.18-09-2019 2/2 Misc. No. 48514 of 2019. Petitioner is in custody since 18.12.2018 having clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IV, Samastipur in connection with Shahpur Patori P.S. Case No. 413 of 2018.
