JUSTICE SATYAVRAT VERMA ORAL ORDER 11-01-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks regular bail in connection with Saur Bazar P.S. Case No. 54 of 2021 instituted for the offences under Sections 25(1)AA/25(1-b)a, 26 and 35 of the Arms Act. Learned counsel for the petitioner submits that the petitioner is in custody since 31.01.2021, is a person with clean antecedent and charge-sheet has been submitted in this case and is aged about 55 years.

Allegation is of recovery of a loaded pistol and 13 live cartridges along with one loaded Magazine.

Learned counsel for the petitioner submits that petitioner is now aged about 55 years and is a person with clean

Patna High Court CR. MISC. No.39957 of 2021(2) dt.11-01-2022 2/2 antecedent and at this stage would not indulge in such activity and he has been falsely implicated merely because he was found at the place of occurrence along with other accused person of which the petitioner was not aware.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 31.01.2021, charge-sheet has been submitted in this case and the petitioner is a person with clean antecedent let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saur Bazar P.S. Case No. 54 of 2021.
