At the outset, learned counsel for the petitioner has submitted that due to mistake, the present civil miscellaneous has been filed instead of filing appeal under order 43 of the Code of Civil Procedure, 1908.

The present civil miscellaneous petition is dismissed as not maintainable with the observations that if the petitioner takes the recourse of appropriate forum it may be at liberty to consider the point of delay, as per the provisions of Section 5 of the Limitation Act.
