The petitioner seeks bail in Ghoswari P.S. Case No. 39/2018, registered for the offences punishable under Sections 304(B), 120(B), 34 of the Indian Penal Code.

As per prosecution case, this petitioner, who happens to be husband of the deceased, along with other accused persons killed the daughter of the informant due to non-fulfillment of demand of dowry. It has been submitted on behalf of the petitioner that wife of petitioner was suffering from various ailment and due to which she died. It is further submitted that petitioner had given information to his in-laws about the death of the deceased. As such, there is no motive for committing murder of the deceased. Learned Additional P.P. vehemently opposed the bail

Patna High Court CR. MISC. No.5081 of 2021(2) dt.06-04-2021 2/2 application of the petitioner and submitted that deceased has died in her Sasural in mysterious circumstances within seven years of marriage and there is specific allegation of demand of dowry against this petitioner.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of petitioner is rejected.
