Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.
This is the second attempt on behalf of the petitioner for grant of anticipatory bail in connection with Ghosi P.S. Case No. 494 of 2020 registered under Sections 341, 323, 325, 307 and 504/34 of the Indian Penal Code. In view of recent decision of the Supreme Court in the case of G.R. Ananda Babu vs. State of Tamil Nadu and Another reported in 2021 SCC OnLine SC 176, this second anticipatory bail application is not maintainable. It is accordingly, dismissed.
However, if the petitioner surrenders in the Court below within a period of four weeks from today and seeks
Patna High Court CR. MISC. No.30188 of 2022(2) dt.22-06-2022 2/2 regular bail, the Court below shall consider and decide the same in accordance with law without being influenced by the order of this Court. While deciding the matter, the Court below shall also consider the fact that there is case and counter case from both the side and the allegations against the petitioner are general and omnibus.
