The petitioner apprehends his arrest in connection with Chanpatia P.S. Case No. 226 of 2017, registered for the offences punishable under 147, 148, 149, 341, 323, 324, 308, 379 and 504 of the Indian Penal Code. The informant named nine persons including the petitioner, Satendra Ram, and alleged that they all surrounded the informant. Co-accused, Rajesh Ram, assaulted the informant with iron rod on his head and coaccused, Santosh Ram, inflicted dagger blow. Learned counsel for the petitioner submits that of course the petitioner, Satendra Ram, is named in the First Information Report, but no specific allegation is made against him. Patna High Court Cr.Misc. No.56997 of 2017 (2) dt.18-12-2017 2/2 Information Report that the motive of occurrence is that the she-goat of the co-accused, Rajesh Ram, was grazing the field of the informant and the informant had chided the sister of the co-accused, Rajesh Ram, and that is why the occurrence took place.

Considering the aforesaid facts and the fact that the petitioner is not alleged to have assaulted the informant, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, West Champaran at Bettiah, in connection with Chanpatia P.S. Case No. 226 of 2017, subject to the conditions as laid down under Section 438(2) of the Criminal Procedure Code. (Prabhat Kumar Jha, J) Praveen-II/- U T
