A reply to the rejoinder filed by the petitioner has been filed on behalf of the respondent no.5, in which, it is stated that office of the District Education Officer, Buxar prepared a list of candidates for appointment on the post of School Assistant and school Parichari on the basis of seniority of death of deceased employees. The name of petitioner appears at serial no.7. The power of appointment on compassionate basis has been vested

Patna High Court CWJC No.11199 of 2019(5) dt.13-05-2024 2/2 to the Panchayat Raj institution and Nagar Nikay institution for appointment on the post of Parichari. Therefore, the District Programme Officer (Establishment), Buxar has sent the list of candidates to the Chief Executive Officer, Zila Parishad, Buxar vide memo no.180 dated 22.04.2023.

Considering this fact, I hereby direct the Chief Executive Officer, Zila Parishad, Buxar to pass a reasoned and speaking order, after affording opportunity of hearing to the petitioner or his counsel, within a period of six weeks.
