Petitioners seek bail in Dhamdaha PS Case No. 95 of 2013 registered under Sections 147, 148, 149, 307, 302, 201, 120(B) and 504 of the IPC pending in the Court of CJM Purnea. It is submitted by petitioners' Counsel that falsity of the allegation will be evident from the fact that 96 persons have been implicated by name. Petitioners happen to be amongst 96 persons. 40 - 50 unknown persons have also been implicated. The petitioners have no criminal antecedent. Other than general and omnibus allegation of assault there is nothing

Patna High Court CR. MISC. No.38874 of 2019(3) dt.17-08-2019 2/2 on record against the petitioners. The petitioners are in custody since 19.12.2018. Other co-accused persons have been allowed bail in Cr. Misc. Nos. 10785 of 2019, 69256 of 2018, 8084 of 2018, 53644 of 2013 and 50992 of 2013.

Considering the aforesaid submissions as also the facts and circumstances of the case, prayer for bail of the petitioners is allowed. Let the petitioners above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) by each one of them with two sureties of the like amount each to the satisfaction of CJM Purnea in Dhamdaha PS Case No. 95 of 2013 on the following conditions:- (i) That one of the bailors will be a close relative of each of the petitioners who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioners will be well represented on each date in the trial and if he fails to do so on two consecutive dates, his bail will be liable to the cancelled.
