Petitioner is apprehending his arrest in Raushanganj (Bankeybazar) P.S.Case No.75 of 2017 registered for the offences under Sections 406 and 420 of I.P.C.

Allegation against the petitioner is of taking money from some persons for providing them houses under Pradhanmantri Gramin Vikas Yojna.

Submission of the learned counsel for the petitioner is that the petitioner has been falsely implicated in this case and he never took money from them.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant

Patna High Court Cr.Misc. No.46349 of 2018 (2) dt.13-08-2018 2/2 anticipatory bail to the petitioner. His prayer for bail is rejected. However, petitioner may surrender before the learned court below and pray for regular bail which will be considered by the court below on its own merit without being prejudiced by this order.

With the aforesaid observation, this application is dismissed.
