2. Counter affidavit filed by learned counsel for the State is taken on record.

3. Earlier the prayer for bail of the petitioner was rejected vide order dated 24.04.2024 in Cr. Misc. No. 28620 of 2024.

4. The petitioner seeks bail in connection with Hajipur Town P.S. Case No. 458 of 2021 registered for the offence punishable under Sections 395 of the Indian Penal Code to which Section 412 of the IPC was added.

5. The petitioner has renewed his prayer for bail and has submitted that he is in custody since 19.07.2021 and since the trial is being delayed by the prosecution, he may be granted

6. From the counter affidavit of the learned counsel for the State, it appears that the trial is proceeding and out of 26 witnesses, 15 witnesses have already been examined and the police is taking all steps for examination of the remaining witnesses.

7. Considering the aforesaid, I am not inclined to review my earlier order.

8. Accordingly, the application stands dismissed.

9. The Superintendent of Police, Vaishali is directed to ensure the appearance of the remaining witnesses on each and every date so that the trial is not delayed.

10, The trial Judge will also ensure the speedy disposal of the trial.

11. Let a copy of this order be communicated to the Principal District and Sessions Judge, Vaishali at Hajipur and the Superintendent of Police, Vaishali forthwith through FAX or e-mail for its compliance.
