Petitioners seek regular bail in a case registered for the offence punishable under Section 304B/34 of the Indian Penal Code.

As per the prosecution case, these petitioners along with other accused persons are alleged to have killed the sister of informant for non fulfillment of demand of dowry. Learned counsel appearing for the petitioners submits that petitioners are father-in-law and mother-in-law of the deceased and they are separate from the deceased in mess and property. There is no specific allegation against these petitioners and Sunil Bind, husband of the deceased, has already been granted bail by a co-ordinate Bench of this court vide order

Patna High Court CR. MISC. No.40730 of 2021(2) dt.08-10-2021 2/2 dated 24.02.2020 passed in Cr. Misc. No. 66787 of 2019 (Annexure-2). Petitioners are in custody since 04.12.2020 and charge sheet has already been submitted in this case. Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioners, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Kaimur at Bhabua in connection with Chainpur PS case No. 143/2019 on the following conditions:-

(1) Petitioners shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and on his/ her absence on two consecutive dates without sufficient reason, his/her bail bond shall be cancelled by the Court below.

(2) If the petitioners tamper with the evidence or the witnesses, in that case the prosecution will be at liberty to move for cancellation of bail.
