2. The petitioners in paragraph no. 1 of the present writ petition has sought inter alia the following relief(s), which is reproduced hereinafter:- "i. For a direction to the Respondents to pay to the petitioner the amount of revised gratuity in revised scale of Rs. 850-1360 (Old) in ACP MACP Scale Rs. 930034800/ - (G.P. 4200/-). ii. For a direction to the respondents to pay to the petitioner the amount of unutilised leave encashment of 300 days in revised Scale of Rs. 850-1360/- (Old) in ACP/MACP Scale 9300-34800/- (G.P. 4200/-).

iii. For a direction to the respondents to pay to the petitioner the amount of G.I. with 12.5% compound interest.

iv. For a direction to the respondents to pay to the petitioner the amount of difference of Pension from February, 2011 to December, 2015 in old revised scale of Rs. 850-1360/- in ACP/MACP Scale Rs. 930034800/-. v. For a direction to the respondents to pay to the petitioner the amount of D.D.A. with 9% interest from the period of 1982 to 1989.

vi. For a direction to the respondents to pay to the petitioner the amount of difference of Salary from March, 1989 to 31.01.2011 on account of revised scale of Rs. 8501360/- (Old) in ACP/MACP Scale. vii. For a direction to the Respondents to pay to the petitioner the amount of interest of gratuity and pension by the Government Circular bearing No. P-C-2116179/3155 dated 07.11.1981 and pay penal interest upon the entire dues from the dates they became due till dates of respective payment.

Viii. (Any other reliefs) to which the petitioner deemed entitled."

3. Learned counsel appearing on behalf of the petitioners submitted that during the pendency of the present writ petition, the original petitioner (father of the petitioners), who retired from the post of Care Taker on 31.01.2011, has been

Patna High Court CWJC No.8337 of 2022(11) dt.16-07-2026 3/3 paid the substantial retiral dues under all admissible heads save and except the differential amount payable under the Group Insurance Scheme at the rate of 12.5%, the entitlement is stated to be dependent upon the final outcome of SLP (C) Nos. 2141121415 of 2025, pending before the Apex Court and seek liberty to raise the grievance before the appropriate authority after the final outcome in the aforesaid Special Leave Petitions, if occasion so arises.

4. The writ petition stands disposed of with aforesaid liberty.

5. The interlocutory application(s), if any, also stands disposed of.
