2. The petitioner has earlier moved before this Court with a prayer for anticipatory bail which was rejected vide order dated 05.03.2024 passed by a Co-ordinate Bench of this Court in Cr. Misc. No. 73291 of 2023.

3. The petitioner seeks bail in connection with Dighwara P.S. Case No. 402 of 2022 instituted for the offences under Sections 341, 323, 324, 307, 379, 504, 506/34 of the Penal Code.

4. As per prosecution case, the petitioner is said to have given knife below on the neck of the informant but, it hit on his lip causing injury.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence as alleged against him and has falsely been implicated in the present case due to village politics and ulterior motive. Both the parties are co-villagers and there is a previous enmity between them. There is a case and counter case between the parties. The present case is a counter blast of the complaint case no. 3761 of 2022 lodged for the occurrence happened on 08.12.2022 when the informant and his family members has assaulted to the petitioner. He further submits that there is no repetition of knife below and the nature of injury has been reserved by the doctor. The petitioner has one criminal antecedent. The petitioner has voluntarily surrendered on 17.03.2025 and, since then, he is in custody without any rhymes or reason. Charge-sheet has been submitted in this case.

6. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner, stating that the offence alleged is serious in nature.

7. Having heard rival contention of both the parties and considering the entire facts and circumstances of the case as also taking into account the period of custody of the petitioner, let the petitioner, abovenamed, be released on bail on furnishing
