2. The petitioner apprehends his arrest in a case registered for offence under Sections 376, 341, 323, 506, 34 of the Indian Penal Code and Sections 4, 6 of the POCSO Act.

3. As per prosecution case, on the alleged date and time of occurrence, while the informant had gone to attend the call of nature, this petitioner caught her and took her away to his house and thereafter, committed sexual assault.

4. The victim (informant), in her statement recorded under Section 164 Cr.P.C., has supported the prosecution case. The age of the victim, on the date of occurrence, is 17 years.

5. Considering the nature of accusation and statement

Patna High Court CR. MISC. No.32747 of 2024(4) dt.02-09-2024 2/2 of the victim recorded under Section 164 Cr.P.C., the prayer for anticipatory bail of petitioner is rejected.
