The petitioner seeks bail in anticipation of his arrest in connection with Kotwali P.S. Case No. 226 of 2020 dated 14.06.2020 instituted for the offences under Sections 147, 148, 149, 341, 323, 385, 448, 354 and 307 of the Indian Penal Code and Section 27 of the Arms Act.

It has been submitted on behalf of the petitioner that because of construction at a particular site on which claim is staked by the petitioner as well as the informant, an occurrence took place in which there is allegation of resorting to firing. No person appears to have been injured in the occurrence and the charge

Patna High Court CR. MISC. No.30376 of 2020(2) dt.17-12-2020 2/2 under Section 27 of the Arms Act has only been added on the basis of the prosecution side having handed over fired cartridges to the police.

There is a counter version of the occurrence as well.

Seeing the futility of the litigation between the parties, they have decided to settle the dispute amongst themselves.

Considering the background facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of ten weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Kotwali P.S. Case No. 226 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
