JUSTICE PURNENDU SINGH ORAL ORDER 06-05-2024 Heard Dr. Mahtab Ahmad, learned counsel appearing on behalf of the petitioner and Mr. Prabhakar Jha, learned counsel along with Mr. Amitesh Jha, learned counsel for the Uttar Bihar Gramin Bank.

2. Learned counsel appearing on behalf of the petitioner submitted that he has received instruction that the petitioner has been convicted and against the conviction order he has preferred criminal appeal. Petitioner was dismissed from service and against the dismissal order, an appeal was filed by the petitioner and the appellate authority has upheld the punishment order. Learned counsel further informs that charges levelled against the petitioner in the departmental proceeding

Patna High Court CWJC No.14103 of 2012(4) dt.06-05-2024 2/2 was on the basis of charge in the criminal proceeding and, as such, he has every liberty to take steps after the final order is passed in Criminal Appeal preferred by him.

3. On these grounds, learned counsel for the petitioner seeks to withdraw the present writ petition.

4. Accordingly, the writ petition stands dismissed as withdrawn.
