The petitioner seeks bail in Purani P. S. Case No. 169 of 2018 instituted for the offence under Section(s) 307/34 of the Indian Penal Code and Section 27 of the Arms Act. In the written report, it is alleged that two unknown persons came on motorcycle and pillion rider got down from the motorcycle and fired on the informant causing injury on his back. It is further alleged that informant had seen Jawahar Yadav and Raj Kishore Yadav were talking and giving indication towards the house of the informant. Learned counsel submits that the name of this petitioner has surfaced in the instant case on the basis of
Patna High Court CR. MISC. No.28206 of 2019(2) dt.30-04-2019 2/2 confessional statement of co-accused Manish Mandal. No TIP has been held in this case. Petitioner has been apprehended merely on suspicion.
Petitioner is in custody since 3.12.2018.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the JM 1st Class, Uda Kishunganj, Dist. Madhepura, in connection with Purani P. S. Case No. 169 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner.
