JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-02-2018 Petitioner apprehends his arrest in connection with Laheriasarai P.S.Case No. 442 of 2015 registered for the offences under Sections 406, 420, 467, 468 and 471 of the Indian Penal Code.
Petitioner is named in the FIR and it is alleged that petitioner along with other accused persons has cheated the informant and further allegation is that he got the land executed in favour of informant and taken Rs.9.6 lacs as consideration amount but that land does not belong to the person who has executed the sale deed.
Submission of learned counsel for the petitioner is that no specific allegation has been attributed against the petitioner and whatever allegation is made that is against Md. Rizwan and Md.
Patna High Court Cr.Misc. No.3938 of 2018 (2) dt.01-02-2018 2/2 Anas and co-accused have been granted privilege of anticipatory bail by a co-ordinate Bench in Cr.Misc.No. 14517 of 2016, vide order dated 28.4.2016 (Annexure-2).

In the facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga, in connection with Laheriasarai P.S. Case No. 442 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioner will co-operate in investigation and will appear before the Investigating Officer as and when required, except on genuine reason, failing which his bail bond shall be cancelled.
