Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner seeks bail in connection Forbesganj P.S. Case no. 274 of 2021 registered for the offence punishable under sections 3(II) (a)(b), 4, 5, 7 of Immoral Traffic Act. Learned counsel for the petitioner submits that petitioner is in custody since 14.4.2021, is person with clean antecedent and charge sheet has been submitted. Allegation is that Shanti Rest House was being used for running brothel and on raid objectionable materials were seized and some male and

No.40416 of 2021(6) dt.13-12-2021 2/2 female customers who were not bonafide customers of the Guest House as their names were not found in the guest register and were found in objectionable condition. Petitioner is owner of the Guest house. Learned counsel further submits that petitioner was completely unaware that such objectionable acts are being committed in his Guest house, the same came as a surprise even to the petitioner.

Learned APP opposes the prayer for bail.

Considering the facts that petitioner is in jail custody, is person with clean antecedent and charge sheet has been submitted, the petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in Forbesganj P.S. Case no. 274 of 2021.
