This application for grant of regular bail arises out of Turkauliya P.S. Case No. 03 of 2019 registered for the offence punishable under Sections 376 and 511 of the Indian Penal Code and Section 4/8 of the POCSO Act.
It is alleged against the petitioner that he had lured the informant's granddaughter, a minor and had taken her to a lonely place and attempted to commit rape on her. The thirteen year old victim has been examined under Section 164 of the Cr.P.C., from which it appears that she too disclosed that the petitioner had induced her to eat something and when she had refused, the petitioner had taken away her to some lonely place. Considering the statement of the victim recorded under Section 164 of the Cr.P.C., which corroborates the allegation in the FIR, which is of grave nature, in my opinion case for grant of regular bail is not made out. This application is accordingly rejected.
The Court observes that the Court below shall take all possible steps for early conclusion of the trial. It is directed that the defect(s) in the application, pointed out by the Registry, must be removed within two months.
Since COVID-19 Pandemic situation is prevailing, the Court has considered it appropriate to adopt following procedure for communication of the present order :- (i) The order, which has been dictated during the course of the proceedings of virtual Court, shall be communicated to me on my e-mail I.D. by the Secretary. (ii) The corrected copy of the order shall be transmitted by me from my e-mail I.D. to the Secretary, which shall be treated to be the authentic copy of the order passed by this Court today in the present proceeding.
(iii) Hard copy of the order, duly signed by me, shall
