JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-12-2020 Heard Mr. Anil Prasad Singh, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Forbesganj (Simraha) P.S. Case No. 923/2019 instituted for the offences under Section 147, 148, 149, 341, 342, 323, 325, 447, 188, 186, 290, 353, 338, 307, 332 and 504 of the Indian Penal Code. The petitioner is named in the F.I.R. along with forty eight other named accused persons and five hundred unnamed accused persons, but there is no specific act attributed to him. Patna High Court CR. MISC. No.30331 of 2020(2) dt.17-12-2020 2/2 been granted anticipatory bail by different Benches of this Court. It has been submitted that the petitioner is a labourer and for no explicable reason, he has been made accused in this case.
Regard being had to the nature of accusation and the fact that the petitioner has been made accused in only one case other than the present case which arises out of same transaction, the petitioner, above named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of ten weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Forbesganj (Simraha) P.S. Case No. 923/2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure (Ashutosh Kumar, J) sunilkumar/- U T
