JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-02-2018 The petitioner is apprehending her arrest in connection with Bhorey P.S. Case No. 240 of 2017, registered for offences punishable under Sections 341, 323, 324, 325, 354 and 307/34 of the IPC.
Allegation against the petitioner is of assault to the wife of informant by hammer.
It has been submitted on behalf of the petitioner that petitioner is a lady and though there is allegation that she assaulted the wife of informant by a hammer on her head, however, the said assault hit the hand of wife of informant, which is not the vital part of the body. Further there is case and counter case between the parties and both sides are agnates.

No.3783 of 2018 (2) dt.01-02-2018 2/2 Having heard both sides, in view of the above facts as well as in view of the fact that petitioner is a lady, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM - XII, Gopalganj, in connection with Bhorey P.S. Case No. 240 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
