The petitioner seeks pre-arrest bail in connection with Thakaraha (Bhitaha) P.S.Case No. 149 of 2017 registered under Sections 420, 467, 468, 471, 353, 120-B/34 of the Indian Penal Code.
It is submitted by the learned counsel for the petitioner that the entire allegation made in the FIR is baseless. The petitioner has neither forged any document nor fabricated the same in order to obtain employment. His maternal uncle is resident of Bihar and he was residing with him and, thus, he obtained Caste Certificate, Character Certificate and Residential Certificate, which were issued after proper verification by the
Patna High Court Cr.Misc. No.60808 of 2017 (2) dt.21-12-2017 2/2 authorities and in this way the petitioner cannot be blamed to have committed any offence.
On the other hand, learned counsel for the State submitted that the petitioner is resident of Uttar Pradesh and, by obtaining Caste Certificate, Character Certificate and Residential Certificate from the authorities in the State of Bihar, he had tried to obtain employment in Armed Force.
Be that as it may, regard being had to the nature of allegation, in the event of arrest or surrender before the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Bagaha, West Champaran in connection with Thakaraha (Bhitaha) P.S.Case No. 149 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
