====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 12-01-2021 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 341, 323, 307, 504, 379, 354, 506, 34 of the Indian Penal Code. Allegation upon the petitioner is that they abused the informant and committed assault to informant's Bhaisur by means of lathi due to which he became unconscious. It is alleged that all the accused petitioner entered in the house of the informant and damaged the house hold articles and after breaking the box looted away cash of Rs. 1500/-, gold ear rings and silver payals.

No.29574 of 2020(2) dt.12-01-2021 2/2 It is submitted by learned counsel for the petitioners that the petitioners are innocent and have been falsely implicated in this case. He submits that there is general and omnibus allegation against the petitioners. He submits that there is case and counter case between the parties. He submits that the injury found upon the victim is simple in nature as opined by the doctor. He further submits that petitioners bear no criminal antecedent as stated in para-3 of the bail application. Learned APP for the State opposed the prayer for bail.

In the facts and circumstances of the case, the above named petitioners in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Madhepura in connection with Gamharia P.S. Case No. 160 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Anjani Kumar Sharan, J) devendra/- U T
