The petitioner apprehends his arrest in Pasraha P.S. case No. 105 of 2017 for the offences punishable under Section 414 of the Indian Penal Code.

The police raided the house of Sahdeo Sah and, on search, one stolen motor cycle was recovered from his house. Sahdeo Sah disclosed that Akhilesh Kumar @ Budha has kept stolen motor cycle in his house.

It is submitted that petitioner is not named in the FIR. During the course of investigation, Akhilesh Kumar @ Budha disclosed the name of petitioner but no stolen article has been recovered from the possession of the petitioner. Considering the facts aforesaid and the nature of

No.8 of 2018 (2) dt.15-01-2018 2/2 allegation made against the petitioner, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Pasraha P.S. case No. 105 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
