The petitioner seeks bail in a case egistered under Sections 366A, 376, 34 of the Indian Penal Code and Section-4 of the POCSO Act.

Prosecution case in short is that on the false pretext of marriage, the co-accused established physical relationship with the informant and thereafter, he refused to marry with her. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 19-02-2019. Charge sheet has already been submitted. The informant had left house with her own sweet will. The victim has been examined u/S 164 Cr.P.C.

Patna High Court CR. MISC. No.28945 of 2019(4) dt.17-08-2019 2/2 in which, she has not made allegation of physical or sexual abuse against the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-Ist-cum-Special Judge, Motihari, East Champaran in connection with Raxaul P.S. Case No. 52 of 2019.
