Petitioners apprehend their arrest in connection with Alauli P.S. Case No. 75 of 2010 registered for the offences punishable under Section 366 of the Indian Penal Code. Allegation as per F.I.R. is of kidnapping of daughter of the informant.

Submission of learned counsel for the petitioner is that in the statement under Section 164 Cr.P.C, the girl has not named the petitioners and moreover, police after investigation, has not found the case true and final form has been submitted but cognizance has been taken now after six years in the year 2017. Heard learned A.P.P. also.

Having heard both sides and in the facts and

No.46389 of 2018 (2) dt.10-08-2018 2/2 circumstances, let the petitioners, named above, in the event of their arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Alauli P.S. Case No. 75 of 2010, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
