Let the defect(s), if any, be removed within a period of four weeks' from today.
The petitioner seeks bail in connection with Daudnagar (Aurangabad) P.S. Case No. 189 of 2023 registered for the offence under Section 120B of the Indian Penal Code and Sections 30A, 32 and 41 of Bihar Prohibition and Exise (Amendment) Act, 2018.
Learned counsel for the petitioner submits that he has four antecedents and there is a total recovery of 1784.52 litres of illegal foreign liquor of different brands and the petitioner is in custody since 04.04.2023.
Learned A.P.P. has vehemently opposed the prayer for
Patna High Court CR. MISC. No.32612 of 2023(2) dt.22-05-2023 2/2 bail.
Considering the period of custody and the allegations levelled against the petitioner, this application for regular bail is allowed.
Let the petitioner, above named, be released on bail after framing of charge if the charge is not framed yet and on furnishing bail bond of 10,000/- (Rupees Ten Thousand ₹ Only) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Aurangabad in connection with Daudnagar (Aurangabad) P.S. Case No. 189 of 2023.
The petitioner will visit Raghopur Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
