The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 347, 341, 323, 354-B, 379, 308 & 504/34 of the Indian Penal Code. Petitioner along with another accused persons intruded into the house of the informant and one Aman Kumar and petitioner tore her attire and snatched his golden chain and other accused persons assaulted the brother and father of the informant.
Learned counsel for the petitioner submitted that no such occurrence as alleged ever took place. The petitioner is quite innocent and has been falsely implicated in this case. The petitioner happens to be cousin brother of the informant. There
Patna High Court CR. MISC. No.30708 of 2019(2) dt.08-05-2019 2/2 is a land dispute between the parties and a partition suit is pending between them. There is no allegation of assault against the petitioner. Petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada in connection with Nawada Town P.S. Case No.99 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
