The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 357, 427, 353, 504, 506/34 of the Indian Penal Code. It is a case of creating hindrance in discharging the official duty of the public servant ie. informant. It is submitted by learned counsel for the petitioner that the petitioner is innocent and have falsely been implicated in this case due to local politics. It is also submitted that the neither the petitioner is apprehended from spot nor anything incriminating recovered from his

Patna High Court CR. MISC. No.31046 of 2022(2) dt.15-11-2022 2/2 conscious possession. Petitioner is a bonafide consumer of the Electric Department and he has never obstructed the work of the electricity department in his official duty. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawadah in connection with Nawadah Town P.S. Case No. 140 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
