In this case, the petitioner is seeking anticipatory bail in connection with Dulhin Bazar P.S. Case No. 236 of 2018 registered for offence punishable under sections 341, 323, 324, 325, 307, 504, 506/34 of the Indian Penal Code. Allegation has been made to have caused injury by knife. The injury report shows that the victim received injury on his head.

The learned counsel for the petitioner submits that the injury is simple in nature as caused by hard blunt substance. It is the opinion of the doctor is not relied upon, as nature of injury itself shows the manner the injury has been caused.

Patna High Court CR. MISC. No.31142 of 2019(2) dt.10-05-2019 2/2 Looking to the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner and accordingly his prayer for bail is rejected. However, if the petitioner surrenders and prays for regular bail, the court below without being prejudiced by the order of this Court, will take decision in accordance with law.
