Petitioner seeks regular bail in a case registered for the offence punishable under Section 365 of the Indian Penal Code.
As per the prosecution case, this petitioner along with other FIR named accused persons and 10-12 unknown persons abducted the son of informant.
Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case only on suspicion. As per FIR son of informant stayed with petitioner at Aligarh for 15 days thereafter he came to his native
Patna High Court CR. MISC. No.40466 of 2021(3) dt.28-01-2022 2/2 town, Samastipur quite safely. There is no specific allegation against this petitioner except the fact that victim stayed with petitioner at Aligarh for 15 days. Similarly situated accused S. Z. Wasfi has already been granted bail by a co-ordinate Bench of this court vide order dated 30.09.2020 passed in Cr. Misc. No. 23172/2020. Petitioner is in custody since 08.03.2021 and investigation in this case is complete.
Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Samastipur in connection with Samastipur Town PS case No.112/2018.
