JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-08-2018 Heard the parties. The petitioner seeks anticipatory bail in connection with Srikrishnapuri P.S.Case No. 336 of 2017, registered for offences punishable under Sections 3,4, 5 and 6 of Immoral Traffic Act.

As per F.I.R., allegation against one Chandan Raj, who is Guardian of Boys Hostel Divyadeep, is that after search of the hostel objectionable materials were found, for which seizure list was prepared and apprehended person, Chandan Raj disclosed the name of the petitioner Alok Prasad Sinha @ Dr. Alok Prakash Sinha, who is owner of the flat.

Submission of the learned counsel for the petitioner is that as a matter of fact, the petitioner is posted as a Medical officer, Primary Health Centre at Tarari and the said flat was

No.45116 of 2018 (2) dt.01-08-2018 2/2 given on rent after execution of agreement and rent was being paid through cheque, which was being received by the daughter of the petitioner in her account and he has no concern of the occurrence and the petitioner has no criminal antecedent. Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, surrender be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna in connection with Shri Krishnapuri P.S.Case No. 336 of 2017, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court and with further condition that the petitioner shall cooperate in the investigation and make himself available as and when required, otherwise his bail bond shall be cancelled.
