The petitioner apprehends his arrest in connection with Triveniganj P.S. Case no. 272of 2017, registered under Section 7 of the Essential Commodities Act.
The accusation is that in course of patrolling duty, one Tata Magic vehicle was searched and it was found that 25 bags, each containing 50 Kg. of rice printed with FCI logo, were recovered. One person, who was boarded on the vehicle, succeeded to flee away, but driver of the vehicle was apprehended, who disclosed his name as Binod Yadav and he also disclosed that that the loaded rice was purchased by Shambhu to FCI Chairman Bhola Yadav. The driver of the vehicle did not disclose the name of owner of the vehicle and he also succeeded to flee away.
Learned counsel for the petitioner submits that it would
Patna High Court Cr.Misc. No.56697 of 2017 (2) dt.07-12-2017 2/2 appear from the F.I.R. that petitioner is the driver of the vehicle and he has no concerned about selling and purchasing of the alleged seized 25 bags of rice, which is said to be of F.C.I. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-1, Supaul in connection with Triveniganj P.S. Case No. 272 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
