Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner has preferred this application for grant of regular bail in a case registered under sections 8(c) and 21(a) of the N.D.P.S. Act.

As per the prosecution case, on information, the police searched the petitioner and 23 pudiyas of heroin/morphine like substance weighing total 8 mg was recovered from the right pocket of the jeans of the petitioner. Learned counsel for the petitioner has submitted that

Patna High Court CR. MISC. No.30404 of 2022(2) dt.09-11-2022 2/2 the petitioner is innocent and has falsely been implicated in this case. The recovered contraband is small quantity. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 03.12.2021.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of detention, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Patna in connection with Khagaul P.S. Case No. 301 of 2021.

The application stands allowed.
