The petitioner seeks pre-arrest bail in connection with Harsidhi P.S. Case No.284 of 2017 registered under Sections 302 and 201 of the Indian Penal Code.
Regard being had to the gravity of the offence and the fact that the name of the petitioner transpired in course of investigation and the police may require his custodial interrogation, I am not inclined to grant him bail. Accordingly, the application filed under Section 438 of the Code of Criminal Procedure is rejected.
In case the petitioner surrenders and seeks bail, the same
Patna High Court Cr.Misc. No.57811 of 2017 (2) dt.20-12-2017 2/2 shall be considered on its own merits without being prejudiced in any manner by this order.
